WOURLD LEGEND CONTRACTING LLC: has established this Safe Driving program to ensure the health and safety of its employees and clients, by increasing awareness of the risks associated with driving and reducing the number of motor vehicle accidents.

Goals

  • Shows the commitment of (World Legend Contracting)’s management and workers to health and safety.
  • Aims to remove or reduce the risks to the health, safety and welfare of
    all workers, contractors and visitors, and anyone else who may be affected by our business operations.
  • Aims to ensure all work activities are done safely.

Responsibilities
Management (the supervisor and / or manager) is responsible for providing and maintaining:

  • A safe working environment.
  • Safe systems of work.
  • Plant and substances in safe condition.
  • Facilities for the welfare of all workers.
  • Any information, instruction, training and supervision needed to make sure that all workers are safe from injury and risks to their health

Workers are Responsible for:

  • Ensuring their own personal health and safety, and that of others in the workplace.
  • Complying with any reasonable directions (such as safe work procedures, wearing personal protective equipment) given by management for health and safety.

WOURLD LEGEND CONTRACTING LLC. is committed to providing and maintaining a safe and healthy working environment for all employees, contractors and visitors. In line with this commitment and adhering to the Tobacco Products Control Act of 2001, LEGEND Brands has adopted a Non-Smoking Policy in the company premises. Smoking is strictly prohibited within all company work areas and public spaces including conference rooms, private offices, reception areas, restrooms, stairwells, hallways, work stations, warehouses, canteens and all other enclosed areas frequented by employees during the course of their employment. This policy applies to all employees, clients, contractors and visitors.
The objective of this policy is to provide a smoke-free environment at all company premises, in order to achieve a healthier and pleasant work place, safeguard non-smokers from the risks to health of passive smoke and protect the company sites from increased risk of fire.

Where it is feasible, designated smoking areas may be assigned by the company; although LEGEND Brands recognises the harmful effects of tobacco smoke mainly due to increased risk of contracting lung cancer and heart disease. All employees, contractors and visitors are expected to abide by this policy when performing activities at LEGEND Brands sites as well as to comply with the non-smoking policy in force, in any other place where they may be called to perform activities for the company.

Implementation

Smoking is strictly prohibited in any part of the company premises, except in any designated smoking area(s) assigned by the company. Smokers are not to smoke immediately outside the entrances to company premises.

No designated smoking area can be assigned in work places, operating areas (hazardous and non-hazardous) or places that must be crossed to reach smoke free areas. Notices and signs will be provided to indicate areas in which employees and visitors can smoke.

In any place, except in designated smoking area(s), the right of non-smokers to breathe clean air prevails over the right of the smokers to smoke.

Smokers may have reasonable smoking breaks, provided these are approved by their Supervisor.

A formal review of this policy will be conducted on a periodical basis.

When smoking or otherwise using tobacco or similar products outside, do not leave cigarette butts or other traces of litter or tobacco use on the ground.

Persons observing a violation of this policy should bring it to the attention of their supervisor. All complaints received will be investigated as confidentially as possible. All personnel are expected to cooperate fully with any such investigation. The Group will institute disciplinary proceedings for non-compliance with this policy.

In recognition of Health, Safety and Environment concerns, LEGEND Brands encourages its employees, contractors and visitors to quit smoking.

Establish measure and review our HSE objectives and continually performance through effective implementation.
Provide training and resources to our employees to ensure that they have the necessary knowledge, skills and competencies to perform their tasks in a safe & healthy and in an environmental friendly manner
This policy will be reviewed annually by top management and where deemed necessary will be amended and re-issued. Previous versions of this policy are archived.
This policy is available to relevant interested parties, upon reasonable request.
General Manager

The purpose of this policy is to ensure public safety and to maintain a safe, and productive work environment for all employees by preventing accidents or other dangerous incidents that may result from drug or alcohol use. This policy pertains to all employees of the company who have cause to be on company vessel(s) and other properties. The possession, use or sale of alcohol on company premises during work hours is strictly prohibited. Further, the possession, use or sale of illegal drugs is prohibited at any time.

Employees are prohibited from reporting to work under the influence of alcohol or drugs.  An employee who is taking a prescription drug is required to present to the company a statement from the prescribing physician that the prescription drug will not impair the employee’s work performance. The company will require drug testing of applicants for employment in safety-sensitive positions.  Any applicant who refuses to submit to the test will no longer be considered eligible for employment.  The company will require drug testing of employees who hold safety-sensitive positions.  Any employee who refuses to submit to the test will no longer be considered eligible for employment.

Drug testing shall be conducted in accordance with DOT/USCG rules and regulations. Specifically, individuals will be tested for the presence of controlled substances [marijuana, cocaine, opiates, amphetamines, phencyclidine (PCP) and alcohol] and will be subject to pre-employment, reasonable cause, periodic, random, and post-accident drug testing. Such individuals MUST TEST NEGATIVE for the presence of controlled substances.

In the interest of the safety and health of its employees, the company reserves the right to inspect and search, at random, unannounced times, all packages, boxes, clothing or any personal belongings carried on or off company, property. DISCIPLINE: Employees found to be in violation of this policy by either directly possessing or using alcohol or drugs, as described above, or through a verified positive drug test or by court conviction, will be subject to immediate discharge from employment. Any employee who fails to cooperate with the requirements set forth in this policy, including refusal to test, failure to provide a specimen within a reasonable time, failure to report for a scheduled appointment to provide a specimen or adulteration of a specimen, will be subject to disciplinary action which may include immediate termination of employment.

ADMINISTRATIVE: The company strictly prohibits the use, possession and/or sale of illegal drugs, drug paraphernalia or unsanctioned use of alcohol aboard company vessel(s) or property. The company will cooperate fully with public authorities in the prosecution of anyone in violation of said prohibition.

Information concerning drug and/or alcohol test results and information concerning violations of this policy will be treated as confidential information. Such information will be released only to management representatives who have a need to know. This information will also be provided to the Coast Guard or other federal and state agencies where required by law or regulation. Test results or documentation showing the employee has been subject to random drug testing shall be provided to that employee or to his/her designated representative, upon written request by the employee.

ALCOHOL AND DRUG POLICY ACKNOWLEDGMENT

Policy statement:

WOURLD LEGEND CONTRACTING LLC: has established this Safe Driving program to ensure the health and safety of its employees and clients, by increasing awareness of the risks associated with driving and reducing the number of motor vehicle accidents.

Scope and definitions:

This program applies to those employees who routinely operate company owned/leased or privately owned/leased vehicles for company business.

  • A routine driver is an employee whose job responsibility requires the use of a company/personal vehicle for work purposes on a regular basis.
  • A motor vehicle is a vehicle driven on public roads (i.e., does not include a fork lift).

Goals and Objectives:

  • To increase employee awareness of the risks associated with work-related driving
  • To provide safe vehicles for employee use
    To reduce the frequency and severity of motor vehicle collisions

Responsibilities:

The Manager Human Resources is designated with the responsibility for the overall implementation of this Safe Driving Program.
Employer responsibilities include:

  • Developing a vehicle safety program
  • Taking every reasonable precaution
  • Ensuring company vehicles provided include such standard safety features as driver and passenger airbags, daytime running lights, ABS brakes and seat belts
  • Maintaining company vehicles to the standards of the Highway Traffic Act and the manufacturer’s recommendations
  • Ensuring employees are aware of the Safe Driving Program through training at orientation and periodically thereafter
  • Having drivers carry proper insurance
  • Informing employees of hazards related to driving
  • Ensuring employees have a valid driver’s license
  • Requiring pre-trip vehicle inspections
  • Removing from service any vehicle with identified problems
  • Assessing the program annually in conjunction with the JHSC/H&S representative(s)
  • Maintaining driver performance records
  • Making safe driving a performance expectation

Manager responsibilities include:

  • Enforcing the Safe Driving Program, including mandatory seat-belt use
  • Ensuring motor vehicle accidents are investigated
  • Removing from service any vehicle with identified problems
  • Monitoring pre-trip inspection records
  • Developing realistic schedules to discourage speeding

Employee responsibilities include:

  • Attending training at orientation, and periodically as required
  • Operating vehicles in accordance with the Ontario Highway Traffic Act, the company Safe Driving Program and other applicable guidelines and standards for the region
  • Maintaining personal vehicles used for work purposes to the standards of the Highway Traffic Act and manufacturers’ specifications and arranging for periodic inspection by a qualified mechanic
  • Providing required driving-related documentation
  • Reporting incidents and near misses (if you are injured in a motor vehicle collision while driving as part of your work, you must report the injury to your supervisor or employer)
  • Reporting vehicle defects immediately to the supervisor
  • Using seat belts
  • Preparing for the journey

JHSC/HRS responsibilities include:

  • Supporting the Safe Driving Program through promotional activities
  • Consulting in the development and review of the Safe Driving Program
  • Consulting in the development and review of safe driver training
  • Monitoring the effectiveness of the Safe Driving Program and making recommendations to the employer
  • Participating in critical injury and fatality investigations as required by the OHSA
  • Participating in work refusals that may occur as a result of work-related driving
